How We Review Copyright Complaints
Copyright complaints may generally go through the following review process.
Notice Received
The copyright notice and supporting information are received.
Notice Reviewed
We review whether sufficient information has been provided.
Appropriate Action
Material may be removed, disabled, corrected, or otherwise addressed when appropriate.
Further Process
Where applicable, notice or counter-notice procedures may follow.
Incomplete Copyright Notices
A copyright complaint must contain enough information for the copyrighted work and complained-of material to be identified.
If a notice is incomplete, unclear, or does not identify the relevant material, additional information may be requested.
Action Following a Valid Notice
When appropriate, GainBuilt Fitness may remove or disable access to material identified in a sufficiently complete copyright infringement notice.
Where applicable, we may also provide information about the complaint to the person or party associated with the affected material.
Actions may depend on the facts of the complaint, applicable law, licenses, permissions, ownership information, and other relevant circumstances.
DMCA Counter-Notification
If material is removed or access to it is disabled because of a copyright notice, the affected party may have a right to submit a counter-notification when they believe the removal resulted from mistake or misidentification.
A counter-notification intended to comply with 17 U.S.C. § 512 should substantially include:
- The sender’s physical or electronic signature.
- Identification of the material removed or disabled.
- The location where the material appeared before removal or disabling.
- A statement under penalty of perjury that the sender has a good-faith belief the material was removed or disabled because of mistake or misidentification.
- The sender’s name, address, and telephone number.
- The applicable statement consenting to jurisdiction of the relevant United States Federal District Court as required by Section 512.
- A statement accepting service of process from the person who submitted the original notice or that person’s agent.
Restoration of Removed Material
When the statutory DMCA counter-notification process applies, material may potentially be restored after a valid counter-notification unless the original complainant provides notice of a qualifying court action within the period required by law.
Restoration is not automatic in every dispute. The applicable process depends on the circumstances and law.
False or Misleading DMCA Claims
Copyright notices and counter-notifications should be submitted honestly and only when the sender has an appropriate legal basis.
Knowingly making a material misrepresentation concerning copyright infringement or removal can have legal consequences.
Repeat Copyright Infringement
Where GainBuilt Fitness permits users to submit reviews, comments, account content, or other user-provided material, appropriate action may be taken regarding repeat copyright infringement.
Depending on the circumstances, action may include removing material, restricting content features, suspending access, or terminating relevant account functionality where appropriate and permitted by law.
Third-Party Content, Brands & Trademarks
GainBuilt Fitness may display product names, trademarks, manufacturer names, packaging images, or other materials relating to third-party products.
Third-party trademarks and copyrighted materials remain owned by their respective rights holders.
A copyright notice should clearly identify the particular copyrighted material involved in the complaint.
Unauthorized Copying of GainBuilt Fitness Content
GainBuilt Fitness may take action when original website content is copied or republished elsewhere without appropriate authorization.
Depending on the circumstances, this may include contacting the website operator, hosting provider, platform, search provider, or another relevant service.
Copyright enforcement decisions depend on actual ownership, licenses, permissions, applicable exceptions, and the facts of each case.

This page provides a process for receiving and reviewing copyright-related communications.
